LITIGATION UPDATE

Adams/Barnes/Bates Update - 4/21/06

            As you are aware, all successful plaintiffs in Adams, Barnes and Bates will receive an additional check as their share of attorneys' fees and costs resulting from the successful litigation. The reason this money has not yet been distributed to successful plaintiffs is that the Bates matter is still on-going.

            Earlier this month, our office sent copies of the individual pay registers and final calculations received from the government to all eligible Bates plaintiffs for review. The deadline to inform our office of any discrepancies with this information is April 21, 2006. Following the resolution of any discrepancies that are reported, the government will then submit this information to the National Finance Center for final processing. Once the Bates matter is complete and the government has paid all attorneys' fees and costs, we will then be in a position to apportion such fees and costs among all successful Adams/Barnes and Bates plaintiffs. At this time, we do not know how long this process will take.
