UPDATE:  JULY, 2005

TO ALL GS-11 AND GS-12 SUPERVISORY IMMIGRATION ENFORCEMENT AGENTS

            As most of you know, we have been gathering information to determine whether or not we should proceed with further litigation as a result of the re-classification of GS-9 and GS-10 Detention Supervisors to GS-11 and GS-12 Supervisory Immigration Enforcement Agents (SIEA).   Initially, we asked you to provide initial information to help us determine whether or not we should go forward with further litigation.  In early July, 2005, our office mailed out a follow-up Questionnaire which asked questions focusing more on your job duties and responsibilities. 

If you have not provided the information requested in the initial information or the follow-up Questionnaire below, please provide this information, by fax at (858) 467-1285 or email to Brad@coplaw.org, to our office no later than July 31, 2005

 INITIAL INFORMATION:

1)                 Name;

2)                 current position and GS level;

3)                 How long you have been at your current position and GS level (month/year);

4)                 What your previously held GS-level and position was as a Detention Supervisor, including dates of such employment (month/year);

5)                 Whether you earned FLSA overtime prior to your re-classification as a Supervisory Immigration Enforcement Agent;

6)                 Whether you are currently earning any FLSA overtime;

7)                 Whether your job duties have changed in any way whatsoever;

8)                 If so, how have your job duties changed;

9)                 Home, cell, and work phone numbers for contacting you;

10)             Email address;

11)             Home address; and

12)             Social security number.

 FOLLOW-UP QUESTIONNAIRE (mailed out early July, 2005):

1)      Do you believe that your job has changed in any significant way since the     re-classification?  YES or NO;

2)      If you answered YES, in what way has your job changed?;

3)      Do you have the authority to hire or fire employees?  YES or NO;

4)      Do you have any role in the hiring or firing of employees?;

5)      If you answered YES, please describe, in detail, what role you play in the hiring or firing of employees; and

6)      Do you supervise 2 or more employees?  

          Please be aware that we are not signing up individual plaintiffs for litigation at this time.  The information you are providing to us does not entail any type of sign-up or guarantee that we will represent you or any other plaintiff in future litigation, should we deem it appropriate to do so.  Please be advised that if we do decide to commence additional litigation, we may ask that you provide us with a retainer.  Please be aware that you are free to commence any litigation you deem appropriate in the interim.
