Since our last update, the Court assigned to this case to Chief Judge Edward J. Damich, the same judge who handled the Angelo case. As required by the Federal Rules of Civil Procedures and Judge's Order, both parties have already exchanged Initial Disclosures, which provides each party with the names of persons with discoverable information.
On April 6, 2006, a Joint Telephonic Status Conference was held with the Court and defense counsel regarding the status of the case. During this conference, the Judge and both parties agreed that this case should be bifurcated into two phases - liability and damages - for both discovery and trial purposes and 2) to identify and select representative plaintiffs from various stations for the purposes of conducting discovery. The Judge then issued a Discovery Scheduling Order informing both parties that discovery on liability must be completed by May 15, 2007. The Judge also ordered both parties to file a Joint Status Report on or before May 19, 2006 to inform him of the progress of identifying representative plaintiffs.
In the meantime, our office is in the process of
initiating written discovery to defendants and scheduling depositions of key
persons disclosed by the government as having discoverable information.
Our office is also working with defense counsel to identify
representative plaintiffs to conduct discovery.
